This Privacy Policy explains how Advanced Creation LLC, doing business as ADV Web Design (“we,” “us,” or “our”), collects, uses, shares and protects personal information. It applies to our website at https://adv.design (the “Website”), to purchases and subscriptions made through it, and to the WordPress plugins we distribute (the “Products”), including ShipWorks Connector for WooCommerce.

This policy is a notice, not a contract. Our contractual terms are set out separately in our Terms and Refund Policy.

1. Who we are

Advanced Creation LLC (DBA ADV Web Design) is the data controller for the information described in this policy.

2. Information we collect

2.1 Information you give us

When you purchase a subscription or create an account, we collect the information needed to complete and support that transaction:

  • Name and company name
  • Billing address, town or city, state, ZIP or postal code, and country
  • Email address
  • Telephone number
  • Account username and password (stored in hashed form)
  • Purchase, subscription and renewal history

Payment card details are entered directly into our payment processor’s secure form. We do not receive, process or store full card numbers on our systems. Our payment processor is Stripe, and its own privacy policy governs its handling of that data.

2.2 Information you give us when you contact us

If you contact us through our contact form, by email, or through the live chat widget on our Website, we collect the contents of your message together with the contact details you supply, so that we can answer you and keep a record of the support provided. Our live chat is operated by Zendesk acting as a processor on our behalf.

2.3 Information collected automatically on the Website

Like most websites, our servers record technical information when you visit, including IP address, browser type and version, operating system, referring page, pages viewed and timestamps. We also use cookies and similar technologies. Non-essential cookies are set only where you have given consent through our cookie banner, and you can change or withdraw that consent at any time using the cookie preferences control on the Website.

2.4 Information our plugins send to us

This section describes data transmitted by software running on your website. We consider it the most important part of this policy, so we state it precisely.

Our subscription-based plugins verify whether the installation holds an active subscription. To do this, the plugin sends a request to our licensing endpoint at https://adv.design containing:

  • the domain name of the website on which the plugin is installed (the HTTP host of the request), and
  • a fixed keyword identifying the type of check being performed.

Nothing else is transmitted. Specifically, our plugins do not send us order data, customer names, addresses, email addresses, telephone numbers, product data, payment information, WordPress usernames or passwords, database contents, or any personal information belonging to your customers.

For ShipWorks Connector, this check runs:

  • at most once every 24 hours, when a site administrator loads a page in the WordPress admin area; and
  • when your ShipWorks desktop software requests orders from your site.

We use the domain name solely to match the installation to a subscription record and to determine whether the free tier or a paid tier applies. A domain name may in some cases identify an individual (for example a sole trader’s personal domain), which is why we treat it as personal information and describe it here.

Order data exchanged between your WordPress site and your ShipWorks software travels directly between those two systems. It does not pass through our servers at any point.

3. How we use information

  • To process orders, subscriptions, renewals and refunds
  • To deliver Products, updates and documentation
  • To verify subscription status and enforce licence tiers
  • To provide technical support and respond to enquiries
  • To send service messages such as renewal notices, security notices and important changes to a Product
  • To maintain the security and integrity of our Website and services, and to detect and prevent fraud or abuse
  • To comply with legal, tax and accounting obligations
  • To send marketing communications, where you have consented; you may withdraw consent at any time using the unsubscribe link in any such message

We do not use your information, or data collected by our plugins, to build advertising profiles, and we do not make automated decisions producing legal or similarly significant effects.

4. Legal bases for processing (UK and EEA visitors)

Where the UK GDPR or EU GDPR applies, we rely on the following legal bases:

  • Performance of a contract — to process your purchase, provide the Products and supply support
  • Legitimate interests — to verify subscription status, secure our services, prevent fraud, and improve our Products; we have assessed that these interests are not overridden by your rights, in part because the data involved is minimal
  • Consent — for non-essential cookies and for marketing email
  • Legal obligation — to retain transaction records for tax and accounting purposes

5. Sharing your information

We do not sell personal information, and we do not share it for cross-context behavioural advertising.

We share information only with service providers who process it on our behalf under contract, limited to what each needs to perform its function:

  • Payment processing — Stripe
  • Email delivery — Gsuite Server

We may also disclose information where required by law, court order or a valid request from a public authority, or where necessary to establish, exercise or defend legal claims. If our business is sold or merged, information may transfer to the acquirer, subject to this policy.

6. International transfers

We are based in the United States and our service providers may process data in the United States and elsewhere. Where we transfer personal information out of the UK or EEA, we rely on appropriate safeguards, such as the European Commission’s Standard Contractual Clauses and the UK International Data Transfer Addendum, together with additional measures where required.

7. How long we keep information

  • Order and subscription records: for as long as the subscription is active and afterwards for the period required by tax and accounting law, ordinarily seven years
  • Account details: until you ask us to delete the account, subject to the retention above
  • Support correspondence and chat transcripts: 5 years from the last contact
  • License verification records (domain names): for the life of the subscription and up to 12 months afterwards
  • Server logs: 180 days

8. Your rights

Depending on where you live, you may have the right to:

  • Access the personal information we hold about you, and receive a copy
  • Correct information that is inaccurate or incomplete
  • Request deletion of your information
  • Restrict or object to certain processing, including processing based on legitimate interests
  • Receive your information in a portable, machine-readable format
  • Withdraw consent at any time, without affecting processing already carried out
  • Lodge a complaint with your data protection authority (in the UK, the Information Commissioner’s Office; in the EEA, your national supervisory authority)

To exercise any of these rights, email us via our form on our contact us page. We respond within one month, and will tell you if we need longer because the request is complex. We will not treat you differently for exercising your rights.

California residents

Under the CCPA as amended by the CPRA, California residents have the rights to know, delete, correct, and to opt out of sale or sharing of personal information. We do not sell personal information and we do not share it for cross-context behavioural advertising, so no opt-out mechanism is required. The categories of personal information we collect are identifiers, commercial information, internet activity information, and, where you provide it, professional information; the sources, purposes and disclosures are described in sections 2, 3 and 5 above. You may exercise your rights using the contact details above, and you may authorise an agent to act on your behalf.

9. Security

We use technical and organisational measures appropriate to the risk, including encryption in transit (HTTPS), access controls, and storage of passwords in hashed form. Payment card data is handled entirely by our payment processor. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. Children

Our Website and Products are intended for business use by adults. We do not knowingly collect personal information from anyone under 18. If you believe a child has provided us with personal information, contact us and we will delete it.

11. Third-party sites

Our Website links to third-party sites and services that we do not control, including WordPress.org. This policy does not apply to them, and we encourage you to read their privacy policies.

12. Changes to this policy

We may update this policy from time to time. We will change the “Last Updated” date above, and for material changes we will provide a more prominent notice, such as an email or a notice on the Website. Please review it periodically.
